#1 Court Lets Trader Joe’s Out of Sticky Situation Over Honey Advertising A magistrate judge in the Northern District of California recently dismissed a putative class action alleging that Trader Joe’s misled its consumers about the purity of its manuka honey. Moore v. Trader Joe’s Co., No. 4:18-CV-04418-KAW, 2019 WL 2579219 (N.D. Cal. June 24, 2019). Plaintiffs commenced a putative class action lawsuit alleging that Trader Joe’s engaged in “false, misleading, and deceptive marketing” by representing that its Trader Joe’s Manuka Honey product was “entirely” manuka honey when, purportedly, the product’s manuka honey content had been “adulterated by the inclusion of cheaper honey.”
#2 Trader Joe’s Dodges Sticky Situation With Dismissal of Manuka Honey False Advertising Lawsuit The Ninth Circuit last month upheld a trial court’s decision to dismiss a false advertising lawsuit against Trader Joe’s concerning the store’s labeling of its Manuka honey. The case, Moore et al. v. Trader Joe’s Co., Case No. 19-16618 (9th Cir.), centered around allegations that Trader Joe’s violated multiple states’ consumer protection laws by falsely labeling its Manuka honey as “100% New Zealand Manuka Honey” when, in reality, only about 57-62% of the honey is derived from Manuka nectar.
#3 Trader Joe’s '100% Manuka Honey' isn’t; and that’s OK Because of its perceived benefits and limited simply and transportation costs, manuka honey is much more expensive than other honey, sometimes costing hundreds of dollars a bottle. It is sold under a grade system developed by manuka honey producers to indicate how much of the nectar that went into the honey derives from manuka. According to the plaintiffs' 2018 lawsuit, Trader Joe's sold "100% New Zealand Manuka Honey" for $13.99 per bottle, though it was also labeled as a relatively low grade. They alleged that tests of its pollen content revealed that it was only 57.3% and 62.6% derived from manuka. Trader Joe's moved to dismiss, arguing that the case was preempted by the federal Food, Drug, and Cosmetic Act. It noted that the FDA allows honey to be sold under the name of its primary flower source, meaning that its honey was entirely manuka honey, albeit of a low grade.
